Did you work as a Manufacturing Worker at an Envases USA, Inc. facility at any time since July, 2019? If so, a manufacturing worker filed a lawsuit styled as a collective/class action. The lawsuit seeks to recover unpaid overtime wages for at least two reasons.
First, the lawsuit alleges that after clocking in, but prior to the employees’ “start” of the shifts, workers have to engage in various pre-shift work-related job duties such as putting on personal protective equipment (“PPE”), proceeding to their work areas, and engaging in shift relief process. Despite performing these types of job duties, the lawsuit alleges that Envases did not pay for such time. Instead, the lawsuit claims that Envases only paid for the scheduled shifts rather than for all of the work performed before and after the scheduled shifts. If you performed integral and indispensable job duties before or after your shift and you were not paid for such time, it is possible that you may be entitled to unpaid overtime compensation.
Second, the lawsuit alleges that Envases miscalculated the workers’ overtime rates during workweeks when they receive incentive payments such as attendance bonuses or other bonuses, which resulted in unpaid overtime.
